1. Dietary supplement; no disease claim

PopFizz™ is a dietary supplement (a fizzing, popping probiotic supplement in powder-stick form) intended to support the normal structure and function of the body. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. It is not a drug, not a medical device, and not a substitute for medical care. Any statement about odor, pH, flora, or urinary-tract support describes a structure/function benefit only.

2. No medical advice

Nothing on the Site, packaging, advertising, social media, or any other Charm material is medical advice or a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified health provider with any question regarding a medical condition, your symptoms, or the suitability of any supplement for you. Never disregard professional medical advice or delay seeking it because of something you read on this Site. If you have unusual discharge, itching, pain, or fever, see a clinician — a supplement is not the answer to a medical problem.

3. Studies, results, and testimonials

References to clinical research describe published studies of the HOWARU® Feminine Health strains (Lacticaseibacillus rhamnosus HN001™ and Lactobacillus acidophilus La-14®) and of cranberry proanthocyanidins, in the doses and, in some cases, alongside other ingredients used in those studies. They describe the strains and ingredients, not results achieved with PopFizz™ itself. Individual results vary and are not guaranteed. Testimonials reflect individual experiences and are not a promise of your outcome; reviewers may have received the product free or at a discount.

4. Who should NOT use PopFizz, or should ask a physician first

Do not use PopFizz™ if any of the following applies, unless your physician approves use in advance:

• You have a known allergy or sensitivity to any ingredient listed on the label (including cranberry, berries, or any component of the probiotic blend, flavor, or base).
• You are pregnant, trying to become pregnant, or nursing.
• You are under 18. PopFizz™ is for adults only.
• Your immune system is weakened, you take immunosuppressant medication, you are undergoing chemotherapy, you have a central venous catheter, or you are seriously ill or hospitalized. Probiotics are not appropriate for immunocompromised people without medical supervision.
• You take a blood thinner (for example warfarin) or any other prescription medication — cranberry and other ingredients may interact with medications.
• You manage diabetes or blood-sugar levels (the product contains small amounts of glucose, fructose, and D-mannose) or you follow a medically restricted diet.
• You have kidney disease or a history of kidney stones, or a digestive, liver, or other chronic condition.
• You have surgery scheduled: stop use at least two weeks before any procedure unless your surgeon says otherwise.

5. Safe-use requirements

• Use only as directed on the label: one stick daily, poured onto the tongue and allowed to dissolve. Do not exceed the recommended amount.
• Do not inhale the powder. Do not give to children; keep out of reach of children and pets.
• Store in a cool, dry place, sealed in the original packaging. Do not use if the seal is broken or the stick is torn, wet, or discolored.
• Discontinue use and consult a physician if you experience any adverse reaction, including rash, hives, swelling, digestive upset that does not settle, or any unexpected symptom.
• A dietary supplement is not a replacement for a varied diet, hygiene, or medical care.

6. Assumption of risk

BY PURCHASING OR USING ANY CHARM PRODUCT, YOU EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK ASSOCIATED WITH ITS USE OR MISUSE, including without limitation allergic or sensitivity reactions, digestive discomfort, interactions with medications or other supplements, or aggravation of an existing condition, whether or not such risk was foreseeable and whether or not caused in part by your failure to follow the label directions or this Disclaimer. This assumption of risk applies to the maximum extent permitted by applicable law.

7. Indemnification

You agree to defend, indemnify, and hold harmless Charm Enterprises LLC and the Indemnified Parties described in the Terms of Service from any claim arising out of your use or misuse of any Charm product, your failure to follow this Disclaimer or the label directions, or any medical condition that made the product unsuitable for you.

8. No warranty of outcome

We make no warranty of any particular result, of suitability for your body, or of fitness for any particular purpose. See the warranty disclaimers and liability limitations in the Terms of Service, which apply to this Disclaimer in full.

9. Adverse-event reporting

If you experience a serious reaction, stop use and contact your physician; for emergencies contact emergency services. You may also report a serious adverse event associated with a dietary supplement to the FDA through MedWatch. We ask (but do not require) that you also report the event to support with your order number, the lot number on the box, and a description, so we can investigate. Reporting does not create any liability, admission, or obligation on our part.

10. International users

PopFizz™ is formulated and labeled for the United States market. If you purchase from or bring the product into another country, you do so at your own risk, are responsible for compliance with local law (including import and supplement regulations), and agree that this Disclaimer, the Terms, and Wyoming law govern to the maximum extent permitted.

11. Changes; acknowledgement

We may update this Disclaimer at any time by posting a revised version. Your use of any Charm product constitutes your acknowledgement that you have read, understood, and agreed to this Disclaimer, including the assumption of risk in Section 6.
